By using or interacting with the Platforms, you accept and consent to the terms of our Privacy Policy in effect at the time of your use or visit. If you are an agent, agency, management company or other customer, information you share with us about your insureds or residents is governed by our contractual terms with you.

Personal information is information that directly or indirectly identifies you or can be used to identify you as an individual. We collect information in the following ways:

Information You Provide. The personal information we may collect includes:

Application Information such as your name, phone number, and email address, as well as any other information that allows us to provide you with insurance services or products, including commercial information. This may include details about your business and status as an insurance agent or broker; your status as owner, director, shareholder, member or partner, or other ownership or management interest in an organization; policy and claim numbers; prior or present insurance policies, coverage and claims; photographs or video recordings received in the course of business such as claims processing; location and identification of insured property such as property address, vehicle license plate, identification number, registration number, or safe deposit box location and number; other insurance you hold; records of services and products you have obtained from us; and other data in activity notes and emails based on our previous communications with you.

Contact information such as your name, email address, phone number, company name, physical address, or any other comments or information you choose to provide in your message or other online and offline communications with us.

Account information such as your name, phone number, email address, zip code, employer ID number and other account credentials.

Business information you provide if you attend an event or as provided through the Platforms, such as your name, phone number, email address, company name and other business information.

Personal Identifiers, including name; date of birth; gender; race/national origin; physical traits; contact details (home and work address, telephone numbers, email addresses); and user name, password, password reminder questions and answers for our Online Services.

Background data, including marital status; family history; educational history; employment history and job titles; professional licenses and affiliations; and relationship to the policyholder, insured or claimant.

Financial information, including bank account number; other account numbers and details for financial institutions or credit cards or payment cards; income; assets (real and personal property); liabilities; credit history and credit score; history of insolvency; and other financial information.

Customer service phone calls and videotaped interviews.

Geolocation data, including where you are located, such as city and state.

Social Media account information. When you use our Portals or follow our Social Media Pages, we may receive additional personal information from you, including personal information that is part of your profile relating to those accounts or your friends’ profiles. Please review the applicable privacy policies for your social media accounts. We are not responsible for the data collection or the privacy practices of any social media accounts.

Inference information. We may draw inferences from any of the information identified in this subdivision to create a profile about you, such as your behavior, attitude, and aptitude.

Information from other sources. We may also collect personal information about you from other sources, including commercially available sources and our business affiliates or partners.

From time-to-time our Site requests information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level).

Information Collected Automatically. We may also automatically collect certain personal information when you visit or use the Platforms using pixels, cookies, or similar tools. A "cookie" is a small data file stored on your browser if you visit the Site. We use pixels and cookies to collect information such as your device type, browser type, and IP address. We also track content you visit on the Site and duration on specific pages of the Site to help us improve your access to the Site and enhance our Platforms. Cookies also enable us to track your general location and similar information that typically remains in aggregate form and does not identify you individually. While we use third-party tools to track interactions with our Site for our internal analytics and marketing purposes, we do not permit third parties to track your online activities over time and across other websites based on your use of the Site. The Site also uses analytics tools such as Google Analytics, a web analytics service provided by Google, Inc. that uses cookies to help us analyze how users navigate the Site. The information generated by this tool (including IP address) will be transmitted to and stored by Google in aggregate form and used to evaluate use of the Site, compile reports on Site activity and other services relating to Site usage. What sensitive personal information do we collect?

We may collect the following categories of sensitive personal information about you and/or your dependents:

Government-issued identification
Identification numbers include but are not limited to Social Security number, other tax identification number, Medicare number, passport number; military identification number, and driver’s or other license numbers.

Health and medical data
Current or former physical or mental or medical condition; biometric and genetic data; history of medical procedures or surgeries; date and cause of injury, disability or death; medication information; medical insurance information; and relevant personal habits such as smoking or drug and/or alcohol consumption.

Other sensitive information
In the course of doing business with you, we may obtain other sensitive information about you, such as data regarding your citizenship and immigration status, sexual life or sexual orientation, religious or similar beliefs, or preferences for medical treatment.

Please note that we do not use your sensitive personal information to infer characteristics about you.

Do-Not-Track Signals

The Site does not currently respond to browser-based "Do Not Track" signals.

How We Use Your Information

Protecting Your Information

We have implemented physical, electronic, and technical safeguards to protect your personal information, consistent with applicable privacy and data security laws.  However, we cannot completely guarantee security of your personal information.  You can help safeguard your personal information by keeping confidential and private all user names, login, and passwords used to connect with our Online Services.

How Long We Keep Your Personal Information

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION RELATED TO THE SITE AND/OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY SO SOME OR ALL OF THE ABOVE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.

ARBITRATION

Any controversy or claim arising out of or relating to this agreement, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of arbitration shall be El Dorado County, California. The arbitration shall be governed by the laws of the State of California.

ENTIRE AGREEMENT; NO WAIVER; ASSIGNMENT

These Terms, together with our Privacy Policy, each as may be amended from time to time, constitute the entire agreement between you and us regarding the Site. Neither the course of conduct between us nor trade practice shall act to modify these Terms. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under these Terms will act as a waiver thereof, nor will a single or partial exercise of any right or power under these Terms preclude further exercise of that or any other right under these Terms. These Terms, and any rights and licenses granted hereunder, may not be delegated, transferred, or assigned by you, but may be assigned by us without restriction. Any purported delegation, transfer, or assignment by you shall be null and void.

SEVERABILITY

If any provision of these Terms is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, such provision will be deleted from these Terms and the remaining provisions will continue with full force and effect.

GEOGRAPHIC RESTRICTIONS

The Site is operated out of the United States. We make no representation that the Site, or content or information available via the Site, is appropriate or available for use outside of the United States, and access to it from jurisdictions where the content is illegal is prohibited. Those who choose to access the Site from outside the United States do so at their own initiative and are responsible for compliance with all applicable local laws.

CHANGES TO THESE TERMS AND THE SITE

We reserve the right to modify these Terms, and to add new or additional terms or conditions on your use of the Site, for any reason, without notice, at any time. Such modifications and additional terms and conditions will be effective immediately and incorporated into these Terms upon posting of revised Terms on the Site. Your continued use of the Site afterward will be deemed acceptance of the then-current Terms. We may modify or discontinue providing the Site more broadly, in whole or in part, at any time, for any reason, without prior notice.

COMPENSATION DISCLOSURE

As a wholesale insurance broker, we provide brokerage, underwriting and other services to retail agents and brokers and generally does not solicit insurance directly from the public. We are compensated in a variety of ways, primarily in the form of commissions paid by carriers and/or fees paid by clients.

We may also receive other forms of compensation from carriers or MGA’s such as employee training and development, fees, contingent income, and supplemental commissions. Contingent or supplemental commissions can be based on profitability, premium volume and/or growth with a carrier. From time to time, we may place business with affiliated insurance intermediaries that may also receive compensation.
